The head of the U.S. Environmental Protection Agency said he would sign a proposed rule on Tuesday to begin withdrawing from the Clean Power Plan, former President Barack Obama's centerpiece regulation to fight climate change.
The EPA feels confident that its decision to eliminate regulation reduces the risk of running afoul of the court decision, and the agency is asking for comments on that.
It was not immediately clear whether Pruitt will seek to issue a new rule without congressional approval, which Republicans had criticized the Obama administration for doing. Which, of course, will nearly certainly be subject to legal challenge from environmental groups.
The Trump administration is expected to propose rolling back the Clean Power Plan today, a major step back from policies put in place by the Obama administration to combat climate change.
The East Kentucky Power Cooperative said they agree with the repeal. Pruitt was among about two dozen attorney generals who sued to stop Obama's 2014 push to limit carbon emissions, stymieing the limits from ever taking effect.
His position on climate change was met with widespread criticism both at home and overseas.
The narrower rule would focus on obtaining efficiency improvements through better heat rates at coal plants - an "inside the fenceline" regulation, rather than a sweeping change to the national power mix. Conservative and free-market groups praised the administration's decision to reverse the Clean Power Plan.

The final rule gave North Dakota a almost 45 percent emissions reduction target, the third-biggest cut in the nation.
The EPA is legally required to take steps to reduce carbon pollution.
States then develop and implement plans that ensure that the power plants in their state - either individually, together or in combination with other measures - achieve the interim Carbon dioxide emissions performance rates over the period of 2022 to 2029 and the final Carbon dioxide emission performance rates, rate-based goals or mass-based goals by 2030.
Conservation Colorado, however, applauded Gov. John Hickenlooper's pledge to stay the course on efforts to reduce carbon emissions in the state.
The Trump administration's move to start dismantling the Clean Power Plan rule meant to curb carbon emissions that contribute to global warming will not be a quick process. Trump, who once called climate change a "hoax", also announced in June that his country will leave the Paris Agreement on curbing global warming. "He put America first and said to the rest of the world, 'we're going to say no and exit the Paris accord.' That was the right thing to do", Pruitt said.
